MAPTIMIZER MOBILE MESSAGING TERMS & CONDITIONS

Agreement to Receive Text Messages
By providing your mobile telephone number and affirmatively opting into a text messaging program offered by Maptimizer (“Maptimizer,” “Company,” “we,” “our,” or “us”), you expressly consent to receive recurring automated and/or non-automated SMS or MMS text messages at the mobile telephone number you provided.
Messages may include consultation confirmations, appointment reminders, customer support communications, account notifications, service updates, scheduling communications, marketing communications, promotional offers, educational content, and other information relating to your interactions with Maptimizer and its local SEO, website, digital marketing, and related services.
Consent to receive marketing text messages is not a condition of purchasing any goods or services from Maptimizer.
By enrolling, you represent that you are the authorized subscriber or customary user of the mobile telephone number provided and that you have authority to consent to receive text messages at that number.
Program Description
Maptimizer’s messaging program is designed to provide communications to prospective customers, existing customers, Clients, and other individuals who affirmatively request information or communications from Maptimizer.
Depending on the communications for which you have opted in, messages may include information regarding consultations, appointments, requested information, customer support, account or service updates, local SEO services, website services, digital marketing services, educational information, promotions, and other communications relating to your relationship with Maptimizer.
The messaging program is intended to facilitate timely communications regarding Maptimizer’s Services and your interactions with the Company.
Message Frequency
Message frequency varies based on your requests, account activity, appointments, communications preferences, and the messaging program in which you participate.
You may receive approximately two (2) to eight (8) messages per month, although message frequency may vary and additional messages may be sent in response to your requests, appointments, customer support inquiries, or other communications you initiate.
Message and Data Rates
Message and data rates may apply according to your wireless carrier and mobile service plan.
Maptimizer does not charge a separate fee to participate in its messaging program; however, your wireless carrier may charge applicable messaging, data, or other fees.
Opt-In and Consent
You may opt into Maptimizer’s SMS messaging program by affirmatively submitting your mobile telephone number through an online form or other enrollment method that clearly discloses the applicable SMS program and requests your consent to receive text messages.
Where applicable, you may also opt in by requesting communications from Maptimizer, scheduling a consultation or appointment, or otherwise providing affirmative consent through a designated SMS enrollment process.
For marketing and promotional messages, your affirmative opt-in constitutes your electronic signature and express written consent to receive recurring automated marketing text messages from Maptimizer at the telephone number provided.
Your consent is voluntary and is not a condition of purchasing any goods or services.
Consent to receive marketing text messages is not required to purchase services, request a consultation, or otherwise interact with Maptimizer.
Where required by applicable law, regulation, carrier requirement, or messaging program rules, Maptimizer may use an additional confirmation or double opt-in process before sending certain messages.
Opt-Out
You may opt out of receiving marketing text messages from Maptimizer at any time by replying STOP to any marketing text message.
After you send STOP, you may receive a single confirmation message confirming that your opt-out request has been processed. After that confirmation, you will no longer receive marketing text messages from the applicable messaging program unless you provide a new affirmative opt-in.
You may also use commonly recognized opt-out keywords, including END, CANCEL, UNSUBSCRIBE, QUIT, STOPALL, or STOP ALL, where supported by the messaging platform.
If you have separately consented to receive transactional, service-related, or other non-marketing communications, opting out of marketing messages may not necessarily terminate those separately authorized communications to the extent permitted by applicable law.

Messaging Technology
Maptimizer may use third-party messaging platforms, customer relationship management systems, SMS application programming interfaces (“APIs”), communication platforms, scheduling systems, and other technology providers to facilitate SMS and MMS communications.
These service providers may process information necessary to deliver, administer, monitor, and maintain the messaging program on Maptimizer’s behalf.
Maptimizer requires applicable service providers to process information in accordance with their contractual obligations and applicable law.
Carrier Disclaimer
Wireless carriers are not responsible for delayed, failed, incomplete, or undelivered messages.
Message delivery may depend on your wireless carrier, network availability, mobile device compatibility, signal strength, geographic coverage, and other factors outside Maptimizer’s reasonable control.
SMS and MMS services may not be available on every wireless carrier, device, or geographic location.
Updating Your Mobile Number
If your mobile telephone number changes, is disconnected, or is reassigned, you agree to promptly update your contact information with Maptimizer.
You should not enroll a telephone number that does not belong to you or that you are not authorized to use.
Maptimizer is not responsible for messages sent to a mobile number that you fail to update or that has subsequently been reassigned, to the extent permitted by applicable law.
Consent Records
Maptimizer may maintain records demonstrating consent to receive text messages in accordance with applicable laws, regulations, industry standards, and wireless carrier requirements.
Consent records may include the mobile telephone number, date and time of consent, IP address, browser information, user-agent information, source or referral information, landing page or form URL, consent language displayed at the time of enrollment, campaign information, confirmation records, opt-out records, and message history.
These records may be retained for as long as reasonably necessary to document consent, administer the messaging program, comply with applicable legal and regulatory requirements, resolve disputes, and protect Maptimizer’s rights.
Privacy
Your participation in Maptimizer’s messaging program is also governed by the Maptimizer Privacy Policy.
Maptimizer does not sell or rent mobile telephone numbers or SMS consent information to third parties for their own independent marketing purposes.
Maptimizer may share mobile telephone numbers and related information with service providers that assist with SMS delivery, customer relationship management, scheduling, customer support, communications, security, recordkeeping, compliance, and operation of the Company’s Services.
Mobile telephone numbers and SMS opt-in data will not be shared with third parties or affiliates for their own marketing or promotional purposes.
Program Changes
Maptimizer may modify, suspend, or discontinue its messaging program or any portion of the program at any time, subject to applicable law.
Changes may include modifications to message content, message frequency, enrollment methods, eligibility requirements, supported keywords, technology platforms, or other program functionality.
Maptimizer may also change the messaging service provider or technology used to administer the program.
Disclaimer of Warranties
THE MESSAGING PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.
MAPTIMIZER DOES NOT WARRANT THAT TEXT MESSAGES WILL ALWAYS BE DELIVERED, DELIVERED WITHOUT DELAY, ERROR-FREE, OR AVAILABLE ON ALL DEVICES OR WIRELESS NETWORKS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAPTIMIZER AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO PARTICIPATION IN THE MESSAGING PROGRAM, INCLUDING DAMAGES RESULTING FROM DELAYED, FAILED, DUPLICATE, OR UNDELIVERED MESSAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAPTIMIZER’S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE MESSAGING PROGRAM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00) OR THE AMOUNT PAID DIRECTLY TO MAPTIMIZER FOR THE APPLICABLE MESSAGING SERVICES DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.
Governing Law
These Mobile Messaging Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict-of-law principles.
Any dispute arising from or relating to these Mobile Messaging Terms or the messaging program shall be subject to the applicable dispute-resolution and jurisdiction provisions contained in the Maptimizer Terms of Service.
Changes to These Terms
Maptimizer may revise these Mobile Messaging Terms from time to time.
Updated versions will become effective when posted on the Maptimizer website unless a later effective date is expressly stated.
Where required by applicable law, Maptimizer will provide notice of material changes through an appropriate method.
Your continued participation in the messaging program following the effective date of revised Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.
